Conveyancer Compared

Terms of use

Version 1.0 · [EFFECTIVE DATE]

DRAFT — not yet published

These terms are published in draft while the operating entity and the contact address are settled. Anything shown in square brackets is not final.

The short version

  • We are a comparison service, not a law practice. We do not give legal advice and we do not do conveyancing.
  • We show you firms that match the answers you give. That is a match, not advice about who to engage, and listing a firm is not a recommendation of it.
  • We do not compare every firm in New South Wales, Victoria, Western Australia, Queensland, South Australia, Tasmania, the Australian Capital Territory or the Northern Territory, and payment never affects where a firm appears.
  • When you click a result you go to that firm's own website. Anything that happens after that is between you and the firm.
  • Fees shown are what the firm advertises, not a quote. Check anything that matters with the firm itself.
  • You may use the site to compare conveyancers. You may not scrape it, copy the directory, or use it to train AI systems.

The summary is here to be read, not to be relied on instead of the terms. The full terms are below.

1. About these terms

Conveyancer Compared (ABN 41 906 406 247) operates this site. These terms apply to the Conveyancer Compared website at conveyancercompared.com.au and conveyancercompared.com, to any address that replaces them, and to the emails we send you.

By using the site you accept these terms. If you do not accept them, please do not use the site. They are for the benefit of Conveyancer Compared and the people who work for it.

Changes. We may change these terms at any time, without notice. The version published on this page, with the date it was last updated, is always the current one. If you use the site after a change, you accept the changed terms.

Your privacy. How we handle personal information is set out in our privacy policy, which is a separate document. Please read it as well.

2. What this service is

Conveyancer Compared is a comparison and information service. It asks you a short set of questions about your property transaction and shows you conveyancers and solicitors whose details match your answers.

We are not a law practice. We do not provide legal services or legal advice, we do not carry out conveyancing, and we do not act for you. Nothing on this site is advice about your property, your contract or your transaction.

We make no recommendation. The site contains no personal recommendation, suggestion or advice about the suitability of any firm for you and your needs. Listing a firm is not an endorsement of it, and the results we show are a match against the criteria you enter. Each result tells you why it was suggested. Before you engage any firm, make your own enquiries about it and obtain your own advice if you need it.

We do not compare every firm. We do not show every conveyancer, settlement agent, conveyancing agent or solicitor practising in New South Wales, Victoria, Western Australia, Queensland, South Australia, Tasmania, the Australian Capital Territory or the Northern Territory. Firms are added to and removed from the site over time, and a firm's absence is not a comment on that firm. The service is for people buying or selling property in those eight states and territories; we do not compare firms in external territories such as Norfolk Island, Christmas Island or the Cocos (Keeling) Islands. Our coverage is not the same in each of them, and outside New South Wales it is thinner everywhere. Victoria is newer and thinner than New South Wales. In Western Australia, Queensland and South Australia we hold a fraction of the firms practising there. Our Northern Territory coverage is thinner again and concentrated in Darwin. Tasmania and the Australian Capital Territory are the newest and the smallest: in the Australian Capital Territory we list a small number of Canberra law practices, and in Tasmania we list firms in Hobart, Launceston, the North West, the East Coast, the Huon and the Derwent Valley but none at all on the West Coast. In parts of every state we may show you very few firms or none — including outside Darwin, Palmerston and Alice Springs, on the Yorke Peninsula and Copper Coast in South Australia, and around Queenstown and Strahan in Tasmania, where we currently list no firm at all.

What payment cannot buy. A firm cannot pay us to rank higher in your results, or to appear at all in a search it does not match. The order of the results is set by how well each firm matches your answers, and it is not for sale. Each result tells you why it was suggested.

How we are paid. We intend to charge firms a subscription to be listed. No firm pays us today. When that changes, a subscription will buy a firm a listing, a partner badge, and a clearly labelled sponsored placement shown above your results. It will never buy a position within the results themselves, and anything a firm has paid to place will always be marked as sponsored.

3. We are not part of your dealings with a firm

Clicking a result takes you to that firm's own website, or shows you its telephone number. We do not send the firm your email address, your answers or anything else about you, and we do not obtain quotes on your behalf. If you want a firm to know who you are, you tell it yourself.

If you go on to engage a firm, that agreement is between you and the firm. Its costs disclosure, its retainer, the work it does, what it charges you and how it handles a complaint are all matters between the two of you. We are not a party to it, we are not your agent and we are not the firm's agent.

We are not responsible for the acts, omissions, advice, fees, conduct or work of any firm listed on this site.

4. Information about firms, and fees

Our directory is built from the public registers of licensed conveyancers kept by NSW Fair Trading and by Consumer Affairs Victoria, from the public register of settlement agents kept by the Department of Energy, Mines, Industry Regulation and Safety in Western Australia, from the Northern Territory Government's public register of conveyancing agents licensed by the Agents Licensing Board, and from firms' own public websites. Two of the places we cover contribute no register at all: Queensland does not license conveyancers, and the South Australian register is not available to us, so every Queensland and South Australian firm on this site was found on its own public website and appears for that reason alone. We record where each detail came from and the date we checked it.

Fees. A fee shown on a card is the fee that firm advertised publicly, as at the date shown beside it. It is indicative only. It is not a quote, not an offer capable of acceptance, and not a price we set or control. What a firm charges you depends on your matter. Where a fee excludes searches, disbursements or GST we say so, but you should confirm what is included with the firm before you rely on the figure.

Accuracy. We try to keep the information on this site accurate and up to date, and we recheck published fees on a cycle. Even so, we do not warrant the accuracy, adequacy or completeness of anything on the site, and you should not rely on it as being accurate, complete or up to date. Confirm anything that matters to you with the firm itself, or with the relevant public register, before you act on it. If you spot an error, please tell us at conveyancingcompared@outlook.com.au.

If you are a listed firm. Write to us at conveyancingcompared@outlook.com.au and we will correct anything that is wrong, or remove your listing entirely, at your request. You do not have to give a reason and you do not have to be a customer of ours.

Names and logos. Firm names, logos and trade marks belong to those firms. We use them to identify the firm. Their appearance on this site does not imply any association with, or endorsement by, that firm.

5. Links to other websites

This site links to websites we do not control, including the websites of the firms we list. Those links are provided so you can reach the firm. They are not an endorsement or a recommendation of the site linked to, or of anything on it.

We take no responsibility for the content, accuracy, currency, availability or security of any website we link to, or for the terms on which it deals with you. Websites change without our knowing. Read the terms and the privacy policy of any site you go on to use.

We record which listings are clicked, so we can tell a firm how many people clicked through to it. We never tell it who. This is explained in our privacy policy.

6. Using the site

You may use this site to compare conveyancers and solicitors for yourself. A firm is also welcome to look at its own listing, and to look at the site if it is considering being listed.

You must not:

  • scrape, crawl, harvest or otherwise collect information from the site by any automated means, or use any robot, spider, script or similar process to do so;
  • copy, republish, redistribute or resupply the directory or any substantial part of it, whether or not you change it first;
  • use the site or its content to train, fine-tune or prompt an artificial intelligence model, or retrieve content from the site automatically other than as a search engine we permit in our robots.txt file;
  • use the site or its content to build, operate or improve a competing directory or comparison service;
  • use systematic or repetitive methods to obtain a large number of results, fees, rankings or provider records;
  • reverse engineer the site, or attempt to identify, probe or manipulate how the ranking works, beyond reading what we publish about it;
  • use the site in any way that breaches any law, or that infringes anyone's intellectual property or other rights;
  • do anything that damages or disrupts the site, or places an unreasonable load on it;
  • send spam or bulk communications through the site, or impersonate any person; or
  • transmit any virus or other harmful code.

If you breach this clause we may suspend or withdraw your access to the site.

7. Our intellectual property

We own or licence the site and everything on it — its design, its text, its ranking model, and the directory we have compiled. Nothing in these terms gives you any right in it beyond using the site as clause 6 permits.

If you send us feedback or suggestions about the service, we may use them without obligation or payment to you.

8. Availability

We take reasonable steps to keep the site running, but we do not guarantee that it will be available, uninterrupted, timely, secure or free from errors, and we do not guarantee that it is free from viruses. We may change, suspend or withdraw the site, or any part of it, at any time.

9. Liability

Your rights under the Australian Consumer Law come first. Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Everything below applies only to the extent the law permits.

Subject to that, your use of and access to this site is at your own risk, and we will not be liable for any loss arising out of, as a result of, or relating to this site, its content, or your use of or access to it, including loss arising from:

  • any error, fault, omission, inaccuracy or misrepresentation in the site or its content;
  • the site being unavailable, or any unauthorised access to it;
  • the transmission of any virus or other harmful code; or
  • anything done or not done by a firm you found through this site.

In no circumstances will we be liable for any indirect, incidental, special or consequential loss, or any loss of profits, however caused. In these terms, loss means any damage, loss, cost, expense or liability, however it arises and whether it is direct or indirect, present or future, actual or contingent.

10. Indemnity

You indemnify us against any loss we suffer arising from your breach of clause 6, or from any unlawful use of the site by you. This clause does not apply to anything else.

11. Emails from us

We send marketing emails only to people who have ticked the box asking for them, and every message carries an unsubscribe link. If your property is in a state we do not yet cover and you have asked us to tell you when we launch there, we will use your address once, for that. Our emails are general information about this service; they are not advice about your transaction.

12. Complaints

About us. If something about this site has gone wrong, write to us at conveyancingcompared@outlook.com.au and we will look into it. Privacy complaints have their own route, set out in our privacy policy at conveyancingcompared@outlook.com.au.

About a firm. We cannot act on a complaint about a firm's work, its fees or its conduct, because we are not a party to your dealings with it and we are not a regulator. Those complaints go to the body that regulates the firm, which depends on where it practises and whether it is a solicitor or a licensed conveyancer. In New South Wales: the Law Society of New South Wales for solicitors, and NSW Fair Trading for licensed conveyancers. In Victoria: the Victorian Legal Services Board and Commissioner for lawyers, and Consumer Affairs Victoria for licensed conveyancers. In Western Australia: the Legal Services and Complaints Committee of the Legal Practice Board of Western Australia for lawyers, and Consumer Protection for licensed settlement agents. In South Australia: the Legal Profession Conduct Commissioner for solicitors, and Consumer and Business Services for registered conveyancers. In the Northern Territory: the Law Society Northern Territory for lawyers, and the Agents Licensing Board of the Northern Territory for licensed conveyancing agents. In Tasmania: the Legal Profession Board of Tasmania for lawyers, and Consumer, Building and Occupational Services for licensed conveyancers. In Queensland: the Legal Services Commission. In the Australian Capital Territory: the Law Society of the Australian Capital Territory. Neither Queensland nor the Australian Capital Territory licenses conveyancers — conveyancing in both may only be carried out by a law practice — so every Queensland and every ACT firm on this site is a law practice and complaints about any of them go to the same place.

13. Suspension, and what survives

We may suspend or withdraw your access to the site if you breach clause 6, or if we withdraw or change the service. If your access ends, clauses 4, 5, 7, 9, 10 and 14 continue to apply.

14. Governing law

These terms are governed by the law of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them. This does not limit any right you have under the Australian Consumer Law, which applies in every state and territory, or your right to bring proceedings where the law otherwise allows.
